Your Studio - Liability Waiver

Assumption of risk

I want to take part in Pilates classes and equipment at Your Studio. I understand that physical activity carries a risk of injury, including strains, sprains, falls and, in rare cases, more serious injury. I take part voluntarily and accept these risks.

Health declaration

I confirm that:

a) I am not pregnant or recently postnatal, or I have medical clearance to take part;

b) I have not had surgery or another medical procedure that makes this activity unsafe or inadvisable;

c) I have no heart, circulatory, breathing or musculoskeletal condition, injury or other health problem that could make this activity harmful to me;

d) I will tell the instructor about any change in my health.

Safety

I will follow the instructor's directions and use the equipment properly. If I feel pain, breathlessness, dizziness or any other problem, I will stop at once and tell the instructor. Instructors are not medical professionals and do not give medical advice. In an emergency, I allow the studio to call for medical help for me.

Release of liability

To the fullest extent permitted by law, I release Your Studio, its owners, staff and instructors from claims for loss, damage or injury arising from my participation, including injury caused by ordinary negligence, and including where I ignored instructions or did not disclose a health condition, except for gross negligence or wilful misconduct. The studio is not responsible for lost or stolen belongings.

Signature

I have read this waiver, I understand it and I agree to it, by signing below or by ticking the box when I book online.

Changing an option rewrites the text, so make your own edits last. This is a template, not legal advice: have it checked against your local law before you use it.

What a good liability waiver includes

A waiver records that a client understands the risks of a class and agrees to take part. Good ones are short and plain:

  • Assumption of risk: names the activity and the kinds of injury it can cause.
  • Health declaration: pregnancy, recent surgery, heart or breathing conditions and injuries, with a promise to tell the instructor about changes.
  • Safety: follow the instructor, stop if something hurts, and permission to call for medical help.
  • Release of liability: what the studio is and is not responsible for, worded for your country.
  • Signature: a name, signature and date, or a ticked box when booking online.

Add a photo and video consent if you post class content, and a guardian clause if you teach under-18s.

Waivers by country

In the UK, Ireland and Australia you generally cannot exclude liability for injury caused by negligence, so the template says so. In the US and Canada, rules vary by state or province, and many courts still won't enforce a release for gross negligence. Treat the output as a starting point for your lawyer, not a finished document.

Need house rules as well? The studio policy generator covers cancellations, no-shows, late arrival and refunds.

Put it to work

A waiver only helps if every client agrees to it before their first class. With booking software for your studio the waiver appears at checkout and clients tick a box to agree. Also available for yoga studios, dance studios and martial arts schools.
